Terms & Conditions of Sale
Please take a few minutes to read our terms and conditions. When making a purchase from our website, www.westerntack.co.uk you are indicating that you agree to be bound by them (your statutory rights are not affected). Please read them carefully and we would recommend that you print a copy for your records. We advise you that we reserve the right to, at any time, to revise our terms and conditions without notice.
All our prices are quoted in UK Pounds Sterling and goods are sold under English law. Prices may be subject to change beyond our control at any given time, but will be updated as soon as possible. If the cost of your order increases, we will contact you and await your instructions. Ordering outside the UK Mainland will incur additional postage charges, please contact us for a postal quotation. On your approval we will raise an invoice for the combined product and postal charge. Please note all prices on our website are GBP sterling and with free UK (only) postage.
All products are subject to availability. The nature of these products means delivery times may be in excess of 30 days. We endeavour to make every effort to carry all items in stock for prompt dispatch. Items in stock will be listed on the website and feature a PayPal link. Those items which are out of stock will not show a PayPal link and will state ‘available to order’ with a link to our contact page. We cannot be held responsible for compensating you for any loss you may suffer if we do not supply the goods. We reserve the right to refuse or cancel an order for goods if it has been listed as an incorrect price due to a typographical error or the price from our suppliers, tax or duty office was incorrect when our price was published.
Postage & Delivery
All prices shown on www.westerntack.co.uk are shown in GBP pounds sterling. These prices include free postage within the UK only.
All products and services offered for sale on this website are subject to availability and may be withdrawn at any time. Pictures are of actual sale items, although we endeavour to be as accurate as possible with photography, they may differ slightly on receipt. If goods cannot be supplied for any reason we will contact you and you will not be charged for the items ordered. If payment has already been taken, you will be refunded the payment (and any postage charges if applicable) immediately.
Overseas Ordering - We are a UK retailer however we will dispatch product outside the UK if requested. However, this is subject to an independent postal charge on top of the website price. This postal charge will vary depending on location e.g. Europe, Americas, Australia. Customers must contact Western Tack with the correct postal address at firstname.lastname@example.org to receive a postal quote. This will then be invoiced along with the product cost and sent to the customer’s email. If overseas orders are returned (not faulty) then the order will be refunded minus any postal charges (sterling charge) incurred to Western Tack and a 20% restocking charge.
Goods charged by credit card are usually despatched within 3 - 5 working days subject to availability, delivery charges will be stated on placement of order. Delivery will always be made to the address provided by you the customer. At times of exceptional demand or out of our control such as supply issues then delivery may take longer, up to 30 days. Special orders (bespoke items) may exceed 30 days. Deliveries will need to be signed for, (delivery will be made by either Royal Mail or a Courier).
We reserve the right to charge an additional postage cost if incurred due to the customer not choosing the correct location for delivery or ordering the incorrect size or colour. We cannot guarantee a time of delivery but will endeavour you receive your delivery as quickly and efficiently as possible.
It is the customer’s responsibility to arrange collection of the goods should they miss the first attempt. There is space during the order process to enter delivery requests if you should think you will not be there to receive the items ordered. If delivery advice is not offered and delivery or your order is missed, we reserve the right to charge any costs incurred to Western Tack for repeated delivery attempts and for parcels returned to us. We will refund the items cost minus the delivery costs and 20% restocking fee. Western Tack cannot be held responsible for non-receipt of items where the customer has entered the wrong delivery details.
Once goods have been delivered to you or your nominated address, Western Tack will not be liable for their subsequent loss or damage. If your order has not been received within 3 working days of the dispatch email notice, please first contact your local Post Office and sorting office as these are the places our undelivered parcels are usually taken.
You should also receive a ‘failed delivery’ card through your letterbox stating time/date the delivery was attempted. Any customer who fails to act on a ‘failed delivery’ card and the item is subsequently returned to Western Tack (you usually have 5 working days to act on the failed delivery) will be asked to pay the cost of re-shipping the item back out to them. If you do not receive the parcel or a failed delivery card within 3 working days, you should contact Western Tack by phone.
Goods- Damaged, Faulty Lost in Transit
On signing for your delivery, please ensure you check you have received the correct number of parcels and that you make a note of any apparent damage to any of the parcels. This must be noted in your consignment note. Ensure your parcels are opened immediately and carefully check the contents as you must inform us within 3 days of any damage or discrepancy i.e. incorrect goods or damage to goods. Western Tack will accept no responsibility for goods lost in transit unless we are notified within 7 working days from the expected delivery date (average 3 days).
Measurements and Weights Guide
Measurements and weights of individual items are approximate and are provided as a helping hand in selecting the best fitting tack. We are more than happy to help and advise you, although we cannot be held responsible for decisions made when choosing a size. Western tack shall have no liability to pay any money to you by way of compensation, other than to refund the amount paid by you for any items in question (based on our returns criteria).
Due to the limitations of photography colours of items you receive may differ slightly to those displayed on your monitor. Western Tack cannot be held responsible for any variations in product specifications implied by our suppliers. If you are in any way dissatisfied with an item, you may of course return it. Any orders cancelled within 14 days may be subject to a 3% charge to cover administration and banking costs.
We will only use the information we collect about you lawfully and never pass your information on to third parties, any information will be held in accordance with the Data Protection Act 1998. No credit card or financial information is retained and transactions are made via PayPal.
Western Tack will not accept any responsibility for damages of any kind arising out of or in conjunction with the use of this website. We make no warranties or representations for any of the contents seen and disclaim all such warranties to the fullest extent. This applies to all damages of all kinds including compensation, direct, indirect or consequential damages, loss or damage to property and claims of third parties.
All images and texts incorporated into www.westerntack.co.uk are the property of Westerntack.co.uk or are used under license from the relevant body and must not be used for any other purpose without consent from the relevant party. It is recommended by Western Tack that the customer prints out a copy of these terms and conditions for future reference but no permission is granted for these terms and conditions to be used in any other capacity without our prior permission.
